Re: Getting a New Gun Delivered RFD to RFD

BFHB - The legally compliant method, as outlined above, has be in force for at least a decade, most likely longer. HOWEVER, police forces have been 'turning a blind' eye to the way MOST RFD's have been operating using the 'old way' of doing things, almost certainly because they were exhibiting common sense as its by far the safer way of transferring a firearm. 8-)

The pertinent fact is in Dromia's post;

"As has been already pointed out this is not new and has been around for years what is new is the insistence of compliance."

What would be interesting to find out is were this change of tack has come from.

BFHB

Every FAC process is based on the guidance provided for the interpretation of the legislation. Do you comply with any of the processes?

As I said earlier you need to challenge that with the certification authorities who are interpreting it and offering the guidance not the messengers who are posting on here. Be sure and let us know what they tell you.

I checked the interpretation with my certification authority and my Trade bodies and reported that here but you seem to know more about this and why I shouldn't comply, so please share.

Also which interpretation of the guidance will you be following?

I gave my thoughts on where this came from in the other thread. I could be wrong but it seemed as though that initiative brought the issue to a head.

I asked the BASC the question about the transfers over a year ago and they could not clarify the issue.
So basically , I just go by what I am told in person by my local rfd.
I do not rely on internet based comment for the rule of law.
What is said on a forum does not make law.
Why would anyone feel the need to tell everyone what they can or cannot do. Sounds like what a dictator would do.

Also guidence is just that - guidence.
I follow the law. Not what someone feels they would like me to.

The law clearly states:

The Firearms (Amendment) Act 1997 which in turn links in with the Firearms Act of 1968.

Part 111, 32-(2)(b): The transferor (seller) must comply with any instructions contained in the certificate or permit produced by the transferee (buyer)

Quote:
1. You must complete each column of table 1 of firearms or table 2 ammunition.

I have attached the BASC pdf on the matter which I found doing a Google search.

I am not telling anyone what to do, I am telling people what I do and why, what they choose to do is up to them.

I should get back onto BASC again then as they seem pretty sure about it now if this document on their website is anything to go by.

https://basc.org.uk/wp-content/uploads/ ... TIONS2.pdf

They quote the relevant sections from the act which you obviously do not accept as law.

I agree, it has puzzled me as well.
