Cheers Sim - spot on !Sim G wrote:There is no statutory definition of "component part". There is case law, R v Clarke and R v Ashton that have given judgement and Home Office guidance advises in Chapter 3 of the current issue, as to what constitutes a component part.
Likewise, the component part of a prohibited weapon is by the virtue of the Act, itself prohibited. However, that part needs to have been assembled as a constituent of the prohibited weapon to generate that status. Hence, a 20 inch barrel taken off a select fire M16 is a prohibited component part and always will be. However, a 20 inch barrel removed from a straight pull s1 AR, is a s1 component. Chop that s1 barrel to 11 inches, it remains a s1 component and continues to be s1 when a two inch muzzle brake is welded on and then fitted back onto the s1 straight pull.
However, if at the stage when the s1 barrel was cut to 11 inches, it was then fitted back to the s1 straight pull, the firearm is now prohibited as per s5, as the components will then always be, from then on.

I have answered your questions your just not reading the answers.
SimG you are completely wrong. Why do the home office want the conversion of the barrel done by a sec 5 if it's ok for anyone to chop a barrel down to sub 12''
Why do I have authority to manufacture sec5 aba components if anyone can chop a barrel down to under12''??????

Re: Permanently attached suppressors ?
I ask because you contradict yourself in those answers.
If your theory ( in the absence of a link to the specific wording relating to shortening a sec 1 barrel ) is correct - any rfd ( or shooter doing it themselves ) who replaced their buffer tube have created a section 5 firearm !

Re: Permanently attached suppressors ?
Anybody can reduce their section 1 firearm to under 24" overall length during replacement of a part of it.AR15 wrote:I have answered your questions your just not reading the answers.

Re: Permanently attached suppressors ?
I haven't contradicted myself. I'll repeat the same information to you again. If you assemble all you sec1 components and the result is s section 5 firearm you break the law. So if you go out shooting with your 12'' 22 ar and no buffer tube you have a sec 5 aba firearm, do you understand that?breacher wrote:Anybody can reduce their section 1 firearm to under 24" overall length during replacement of a part of it.AR15 wrote:I have answered your questions your just not reading the answers.

Re: Permanently attached suppressors ?
A quick email to the home office by RFD's regarding various "grey areas" would stop all this arse nipping. Keep the replies on file for any challenges that may occur in the future

Re: Permanently attached suppressors ?
The removal ( to replace ) of the 12" AR buffer tube is just one example.
How many of us have removed the stock from a carbine which leaves it under 24" until its replaced after modification or cleaning ? And yes - it functions ( can fire ) with stock off.
What about a sub raven - if the weld failed, would the firearm become sec 5 and stay sec 5 even if re welded ?
Mens Rea is important here. If the going sub 12" is momentary and part of cleaning, repair, building or modifying then there is no intention to have a sub 24" firearm as the end result.

Yes - I understand that. But what I asked was "does the firearm become sec 5 as soon as its under 24" and does it stay sec 5 regardless of whether it exceeds 24" after reassembly"AR15 wrote:I haven't contradicted myself. Re: Permanently attached suppressors ?
Again - what act and section specifically mentions shortening rifle barrels ?
