mosin nagant bayonets illegal?

Re: mosin nagant bayonets illegal?
I don't know why the Dealer refused to release the Rifle but I'd speculate it has something to do with the following statement from...
BASC Fact Sheet Scottish Knife Law. Part 5.
5. The Knives Act 1997 makes it an offence to market a knife in a way which indicates
that it is suitable for combat.
Sconie, wouldn't be too hard on the Dealer, a few years ago a over zealous FEO managed to fit more than two non standard cartridges into a Sect 2 Shotgun that your Dealer sold a client. The FEO subsequently caused a lot of grief for your Dealer. Hes just being careful.
I'd blame idiotic scottish politicians, you know the ones that are trying to get complete control of Scottish Firearms.

Cheers Jim, don't worry about it, just my luck to stumble into this bizarre situation, I haven't had my lawyer update me on the actual wording of the law, but surely the dealer was not actually the seller, but the method of delivery to me, no cash transacted between us?
I'm tired and headsore so I'll hit the sack, I will call tomorrow to politely request the return of my property.
After all that's what our laws are built around!

Mmm...silly season firmly upon is!
If a range is a public place then I see quite a few prosecutions in 2014 for discharging firearms in such public places.
Sounds like someone has has a quiet week in the office & been thumbing through some Home Office pamphles, or there has been a regional "team building" bun-fest at which the latest SNP dictat from Herr(durr) Alek Salmond has been inwardly digested in the quest for more SNP gold & a guaranteed warm seat in a cushy charity job: ACPO rools, jobs for the boys...
There was a similar new idea a little while ago...slam fire pump actions are all section 5

One would think that they'd be more concerned with what comes out of the barrel rather than what fits on the end of it
Anyway, good choice in a carbine ..... and bayonet or not, I just know that you are going to have a whole lot of fun once you finally get your hands on it. Hopefully, your lawyer can sort this nonsense out and get these jobsworths off your back.

Ranges... Public places????
I really hope this is not an attempt at making it illegal to shoot, and thus disarm law abiding shooters.

Re: mosin nagant bayonets illegal?
A public place is anywhere that the public have access to, implied, on payment or otherwise. So yes, when a range is open and is being used by clubs/shooters (the public), the range is a public place, but there will still be conditions of entry, such as club membership...
Back to the original post. I have read this and I am absolutely flabbergasted!! I have never heard of anything so utterly ridiculous! Whatever piece of legislation is referred to, you have ample "good reason" to have the bladed article in you possession whilst in a public place, if the reason for having the article is for a lawful purpose.
The bayonet is affixed to the rifle, in the original, historical content. You travelling to and from the range, or any other place connected with the lawful use of the rifle, is the lawful purpose, hence good reason to have the bladed article in your possession.
Your FEO is seriously challenged in basic criminal law and your RFD is a knob for "making this sh1t up"!
The FEO and Police Scotland, by pursuing such a preposterous position may very well be committing offences under the Human Rights Act 1998, The First Protocol, Article 1, Protection of property.

In 1978 I was told by my grand dad that the secret to rifle accuracy is, a quality bullet, fired down a quality barrel..... How has that changed?

I found this link via another forum also discussing this issue :
britishblades.com/forums/showthread.php?24137-Scottish-knife-law-a-reply-from-the-office-of-Lord-Boyd-QC
You can see in the reply that "exceptions would have to be made for sporting, work or cultural.
I would also see section 4 and the defence of carrying the rifle to and from the range would be a good reason.
(4) It shall be a defence for a person charged with an offence under subsection (1) above to prove that he had good reason or lawful authority for having the article with him in the public place.

Re: mosin nagant bayonets illegal?
So a rifle with a bayonet fixed or built in is actually an illegal knife, or something? Bit confuzzled here.

In that case, I just hope that the next Scot who ventures into a public place wearing his kilt and with a knife stuffed down his sock, realises he could be in deep doo-doo.
